Bould Consulting Limited’s Chairman, Martyn Bould was asked by the Society of Mediators to join a distinguished panel of international mediators on 10th August 2013 to provide a Caribbean perspective on Resolving Construction and Commercial Disputes with Mediation-Why Mediate When you can Arbitrate or Adjudicate to some 75 members of the Association of Arbitrators of Southern Africa NPC, Africa’s leading arbitral body.
Moderated by Jonathan Dingle, Barrister and Mediator and Honorary CEO of the Society of Mediators, the panel comprised Stephen Malcolm, Lord Strathcarron, Dr Tracey Towner, Gordon Kwok and Martyn Bould.
The panel addressed to following Key Questions
1 What are the scope of problems that emerge - key answer lack of understanding of contracts and adjudication process
2 What is wrong with Arbitration and Adjudication - key answer cost, time and use of senior staff time away from key activities
3 What from a project perspective can mediation and negotiation skills bring - key answer speedy and cost effective resolution of disputes
4 Does it have to be formal mediation- no key is facilitating interaction that leads to settlement
5 Provide one reason for mediation in construction - key answer-maintaining relationships
