Bould Consulting Limited chairman Martyn Bould has been invited as a panelist to the fifth triennial conference presented by the Caribbean branch of the Chartered Institute of Arbitrators to be held in Trinidad from 15th to 17th October. Martyn specialises in dispute resolution throughout the Caribbean area and has sat as arbitrator/expert witness for matters throughout the Caribbean, including Bermuda, Jamaica, Cayman Islands, US Virgin Islands, Grenada, Trinidad and Tobago, during the past 50 years. Martyn is delighted to be joining a distinguished panel of quantity surveyors and engineers to discuss “Revisiting Construction Arbitration”.

  • Looking at the experiences of the panellists in the use of arbitration in resolving construction disputes,

  • Considering the challenges encountered in its use

  • Discussing whether it has served the construction industry in the Caribbean adequately

  • Looking at how as a final and binding mechanism it has been supplemented by less costly, more expeditious methods, particularly those introduced into the tiered dispute resolution clauses of modern JCT and FIDIC contracts, and

  • Going forward, whether we see an increase or decrease in the use of arbitration and what does the Caribbean region need to do, if anything, to ensure its continued use.
